You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.

You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Faithfully Fit and Free on or through the Site or any service offered on or through the Site. to engage in any other conduct which, as determined by us, may harm FaithfullyFitandFree.com or users of Faithfully Fit and Free or expose them to liability;

contains any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable;
promotes sexually explicit or pornographic material, violence, or discrimination on any basis, including that based on race, sex, religion, nationality, disability, sexual orientation, or age;
infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person;
violates the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations; or
promotes any illegal activity, or advocates, promotes, or assists any unlawful act;
involves commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising; and
gives the impression that the material emanates from or is endorsed by Faithfully Fit and Free or any other person or entity, if this is not the case.

User Contributions

FaithfullyFitandFree.com contains interactive features that allow users to post, submit, publish, display or transmit to other users or other persons content or materials (collectively, “User Contributions”) on or through FaithfullyFitandFree.com.

However, we do not undertake to review User Contributions or any other material before it is posted on or through FaithfullyFitandFree.com and cannot ensure prompt removal of objectionable material after it has been posted. So, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party.

All User Contributions must comply with these Terms. Account Security

FaithfullyFitandFree.com allows users to create an account (“Members”) which requires providing certain information to FaithfullyFitandFree.com. You agree that all information you provide to become a Member and register with FaithfullyFitandFree.com, including, but not limited to, information provided through the use of any interactive features on FaithfullyFitandFree.com, is governed by our Privacy Policy,and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a user name, password, or similar information as part of our security procedures, you agree to treat such information confidential, and agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. Monitoring and Enforcement; Legal Compliance; Termination

You agree that we have the right to:

take any action with respect to any user, Member account or User Contribution that we deem necessary or appropriate in our sole discretion if we believe there to be a violation of these Terms, infringement of third party rights, a threat to the personal safety of others, or a threat or liability or harm to the goodwill associated with FaithfullyFitandFree.com or Faithfully Fit and Free;
take appropriate action, including without limitation, referral to law enforcement and disclosure of your information, for any illegal or unauthorized use of FaithfullyFitandFree.com; and
terminate or suspend your access to all or part of FaithfullyFitandFree.com for any or no reason, including without limitation, any violation of these Terms.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through FaithfullyFitandFree.com. YOU WAIVE AND HOLD HARMLESS FAITHFULLYFITANDFREE.COM WOMENOF FAITH, INC. Faithfully Fit and Free and its contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection, and arrangement of the same), are owned by Faithfully Fit and Free, Inc. and associated entities, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Logos and Designs

The Faithfully Fit and Free name, and logo, all related names, logos, product and service names, designs and slogans are trademarks and/or copyright of Faithfully Fit and Free. You must not use these marks and copyright without the prior written permission of Faithfully Fit and Free. All other names, logos, product and service names, designs and slogans on FaithfullyFitandFree.com are the trademarks of their respective owners.

Intellectual Property Infringement

If you believe that any Faithfully Fit and Free content, including User Contributions, infringes your intellectual property rights, including copyright, please send notice of the copyright infringement to Faithfully Fit and Free via our Contact Us form. Guidelines for parties wishing to use Faithfully Fit and Free’s trademarks, service marks or images.

These guidelines are for Faithfully Fit and Free licensees, authorized resellers, developers, customers, and other parties wishing to use Faithfully Fit and Free’s trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of the keyboard Faithfully Fit and Free Logo (Option-Shift-K) for commercial purposes without the prior written consent of Faithfully Fit and Free may constitute trademark infringement and unfair competition in violation of federal and state laws. Use of Faithfully Fit and Free trademarks may be prohibited, unless expressly authorized.

If you are a licensee of a Faithfully Fit and Free trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines. If you are a Faithfully Fit and Free Authorized Reseller or member of a Faithfully Fit and Free program, you may be subject to additional restrictions.

Faithfully Fit and Free’s trademarks, service marks, trade names, and trade dress are valuable assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using an Faithfully Fit and Free trademark, in whole or in part, you are acknowledging that Faithfully Fit and Free is the sole owner of the trademark and promising that you will not interfere with Faithfully Fit and Free’s rights in the trademark, including challenging Faithfully Fit and Free’s use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any Faithfully Fit and Free trademark. Authorized Use of Faithfully Fit and Free Trademarks

Advertising, Promotional, and Sales Materials: Only Faithfully Fit and Free and its authorized resellers, affiliates and licensees may use the Faithfully Fit and Free Logo in advertising, promotional, and sales materials. Such authorized parties may use the Faithfully Fit and Free Logo only as specified in their agreement with Faithfully Fit and Free and any associated Guidelines and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with Faithfully Fit and Free. Compatibility: Developers may use Faithfully Fit and Free or any other Faithfully Fit and Free word mark (but not the Faithfully Fit and Free Logo or other Faithfully Fit and Free-owned graphic symbol/logo) in a referential phrase on packaging or promotional/advertising materials to describe that the third party product is compatible with the referenced Faithfully Fit and Free product or technology, provided they comply with the following requirements.
The Faithfully Fit and Free word mark is not part of the product name.
The Faithfully Fit and Free word mark is used in a referential phrase such as “runs on,” “for use with,” “for,” or “compatible with.”
The Faithfully Fit and Free word mark appears less prominent than the product name.
The product is in fact compatible with, or otherwise works with, the referenced Faithfully Fit and Free product.
The reference to Faithfully Fit and Free does not create a sense of endorsement, sponsorship, or false association with Faithfully Fit and Free or Faithfully Fit and Free products or services.
The use does not show Faithfully Fit and Free or its products in a false or derogatory light.
Publications, Seminars, and Conferences: You may use a Faithfully Fit and Free word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:
The use is referential and less prominent than the rest of the title. Acceptable: Faithfully Fit and Free “Tour”, “Conference” or “Event”
The use reflects favorably on both Faithfully Fit and Free and Faithfully Fit and Free products or technology.
Your name and logo appear more prominent than the Faithfully Fit and Free word mark on all printed materials related to the publication, seminar or conference.
The Faithfully Fit and Free logo or any other Faithfully Fit and Free-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from Faithfully Fit and Free.
A disclaimer of sponsorship, affiliation, or endorsement by Faithfully Fit and Free, similar to the following, is included on the publication and on all related printed materials: “(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by Faithfully Fit and Free, Inc..”
A trademark attribution notice is included in the credit section giving notice of Faithfully Fit and Free’s ownership of its trademark(s). Please refer to the section below titled “Proper Trademark Notice and Attribution.”
Web Sites: Web sites that serve only as noncommercial electronic informational forums concerning a Faithfully Fit and Free product or technology may use the appropriate Faithfully Fit and Free word mark, provided such use complies with the guidelines set forth in Section 3 above.
Faithfully Fit and Free Web Badge Licensing Program: Web sites may use one of the Faithfully Fit and Free Web Badges if the site uses or was created using Faithfully Fit and Free-branded hardware or software and you comply with the terms of the Faithfully Fit and Free Web Badges License Agreement and Guidelines.

Unauthorized Use of Faithfully Fit and Free Trademarks

Company, Product, or Service Name: You may not use or register, in whole or in part, Faithfully Fit and Free or any other Faithfully Fit and Free trademark, including Faithfully Fit and Free-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

Faithfully Fit and Free Logo and Faithfully Fit and Free-owned Graphic Symbols: You may not use the Faithfully Fit and Free Logo or any other Faithfully Fit and Free-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from Faithfully Fit and Free, such as a reseller agreement.

Variations, Takeoffs or Abbreviations: You may not use an image of a real Faithfully Fit and Free or other variation of the Faithfully Fit and Free logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of a Faithfully Fit and Free trademark for any purpose.

Disparaging Manner: You may not use a Faithfully Fit and Free trademark or any other Faithfully Fit and Free-owned graphic symbol, logo, or icon in a disparaging manner.

Endorsement or Sponsorship: You may not use Faithfully Fit and Free or any other Faithfully Fit and Free trademark, including Faithfully Fit and Free-owned graphic symbols/logos, or icons, in a manner that would imply Faithfully Fit and Free’s affiliation with or endorsement, sponsorship, or support of a third party product or service.

Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing Faithfully Fit and Free or any other Faithfully Fit and Free trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from Faithfully Fit and Free.

Faithfully Fit and Free’s Trade Dress: You may not imitate the distinctive Faithfully Fit and Free packaging, web site design, logos, or typefaces.

Slogans and Taglines: You may not use or imitate a Faithfully Fit and Free slogan or tagline.

For example: “Fit Mind. Fit Body. Fit Spirit.”

Domain Names: You may not use an identical or virtually identical Faithfully Fit and Free trademark as a second level domain name.

Your name does not suggest a false association with Faithfully Fit and Free.

Your name is not confusingly similar to any trademark owned or used by Faithfully Fit and Free.

You acknowledge that Faithfully Fit and Free is the sole owner or licensee of the “Faithfully Fit and Free” trademark and that you will not interfere with Faithfully Fit and Free’s use or registration alone or in combination with other words.
If you are a Faithfully Fit and Free Authorized Reseller, Affiliate or member of a Faithfully Fit and Free program, you may be subject to additional restrictions.

Rules for Proper Use of Faithfully Fit and Free Trademarks

Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service.

As adjectives, trademarks may not be used in the plural or possessive form.

An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that. For a list of suggested generic terms please request the Faithfully Fit and Free Trademark List.

Always spell and capitalize Faithfully Fit and Free’s trademarks exactly as they are shown in the Faithfully Fit and Free Trademark List. Do not shorten or abbreviate Faithfully Fit and Free product names. Do not make up names that contain Faithfully Fit and Free trademarks.

Proper Trademark Notice and Attribution

Distribution Within the United States Only
On product, product documentation, or other product communications that will be distributed only in the United States, use the appropriate trademark symbol (TM, SM, ®) the first time the Faithfully Fit and Free trademark appears in the text of the advertisement, brochure, or other material.
Refer to the Faithfully Fit and Free Trademark List for the correct trademark symbol, spelling of the trademark, and generic term to use with the trademark. Generally, the symbol appears at the right shoulder of the trademark (except the Faithfully Fit and Free Logo, where the logo appears at the right foot).
Include an attribution of Faithfully Fit and Free’s ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.

Distribution Outside the United States:

Do not use trademark symbols on products, product documentation, or other product communications that will be distributed outside the United States without written authorization.

What personal information we collect: When you create a Faithfully Fit and Free, ID, apply for or purchase a product, download a software update, register for a class at a Faithfully Fit and Free Store, connect to our services, contact us or participate in an online survey, we may collect a variety of information, including your name, mailing address, phone number, email address, contact preferences, device identifiers, IP address, location information and credit card information.

When you share your content with family and friends using Faithfully Fit and Free products, send gift certificates and products, or invite others to participate in Faithfully Fit and Free services or forums, Faithfully Fit and Free may collect the information you provide about those people such as name, mailing address, email address, and phone number. Source of your personal information where they are not collected from you: We may have received your personal information from other persons if that person has shared their content with you using Faithfully Fit and Free products services, sent gift certificates and products, or invited you to participate in Faithfully Fit and Free services or forums. We may also validate the information provided by you when creating a Faithfully Fit and Free ID with a third party for security and fraud prevention purposes.

For research and development purposes, we may use datasets such as those that contain images, voices or other data that could be associated with an identifiable person. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices’ approximate location.
